By downloading, installing, or using the FLUX mobile application (the “App”), you agree to be bound by these Terms of Service. If you do not agree to all the terms, you must uninstall and discontinue use of the App immediately.
2. Simulation Platform & STRICT DISCLAIMER OF INVESTMENT ADVICE
PLEASE READ CAREFULLY: FLUX IS STRICTLY A MARKET SIMULATOR AND AI-BASED PATTERN RECOGNITION PLATFORM. IT IS ABSOLUTELY NOT A FINANCIAL ADVISORY SERVICE. • Zero Financial Advice: The information, AI-generated analysis, pattern identifications, and simulation mechanics provided within FLUX do not constitute financial, investment, trading, legal, or tax advice under any circumstances. The App never recommends buying, selling, or holding any real-world asset. • Assumption of Risk: Financial markets (Forex, Cryptocurrency, Stocks) are highly volatile and carry a substantial risk of loss. The App is provided for informational and simulation purposes only. You acknowledge that any real-world trading or investment decisions you make outside of this App are made entirely at your own discretion and risk. • No Guarantee of Accuracy: The AI-driven chart analysis is a supplementary tool and does not guarantee accurate predictions of future market movements. We accept absolutely no liability for any financial losses, damages, or missed opportunities you may incur.
3. Virtual Currency and Simulation Mechanics
FLUX features a simulated market environment. • Fictional Assets: All investments, trades, and portfolio balances within the App utilize virtual currency. • No Real Value: This virtual currency is entirely fictional. It holds no real-world monetary value, cannot be withdrawn, transferred, sold, or exchanged for fiat currency, cryptocurrency, or any tangible goods or services.
4. User Content, Photo Submissions, and Acceptable Use
When you submit or upload photographs for AI pattern analysis, you agree to the following conditions: • You must only upload images containing financial charts or market data. • You agree not to upload any content that is illegal, offensive, explicit, or violates the intellectual property or privacy rights of third parties. • You grant the App a temporary, non-exclusive right to process the image solely for delivering the AI analysis result. • You strictly agree NOT to reverse engineer, decompile, or disassemble any part of the App or its AI algorithms.
We reserve the right to restrict or terminate your access to the analysis feature, without notice, if you violate these terms.
5. Intellectual Property Rights
All original content, features, algorithms, UI/UX design, and functionality within FLUX are our exclusive property and are protected by international copyright, trademark, and intellectual property laws.
6. In-App Purchases, Subscriptions, and Refunds
FLUX offers digital goods and premium features via In-App Purchases. • All transactions are managed securely by the respective app store provider (e.g., Google Play or Apple App Store) and are subject to their specific terms of service. • Refund Policy: We, as the App developers, do not directly process, manage, or issue refunds for any In-App Purchases. However, you may be eligible for a refund directly through the app store provider in accordance with their established refund policies. To request a refund, you must apply directly through the customer support, purchase history, or order management sections of your respective app store account.
7. Third-Party Links and Advertisements
The App contains third-party advertisements served by ad networks (e.g., Google AdMob). We do not endorse, control, or take responsibility for the content, products, or services offered in these advertisements.
8. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP OR THE AI ANALYSIS WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR FREE OF VIRUSES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APP DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO REAL-WORLD FINANCIAL LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
10. Indemnification & Severability
You agree to defend, indemnify, and hold harmless the App and its developers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service, your misuse of the photo upload feature, or any real-world financial losses you suffer.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
